Social Justice II, G. LABOR

  1. We re-affirm the legal right of all workers to organize, to form a union and to bargain collectively without hindrance. This right was guaranteed by the Fair Labor Standards Act of 1936.

  2. To re-enforce that Act, we support Employee Free Choice Act (EFCA) which guarantees the right to form a union by the card-check method.

  3. All workers have the right to inform others or be informed about a union being organized where they work This includes advertising and recruiting.

  4. We demand the repeal of the Taft-Hartley Act which promotes open shop..

  5. Workers must have the following rights and protections:
    1. to elect representatives to the Board of Directors of the business where they work, and their representatives will have equal rights with management.
    2. to elect their own union officers.
    3. No permanent replacement of striking workers.
    4. No forced overtime.
    5. to flexible work schedules to allow managing family or personal affairs.
    6. to be paid a living wage, including temporary or permanent workers.
    7. Until we have universal health care, employer must pay half of workers health insurance.
    8. All workers must have unemployment insurance, workers’ compensation, access to job search programs.
    9. All workers must have minimum pensions, vested and portable.
    10. Mediation must be the first available solution to labor-management disputes, with agreed time limits.
    11. New Union members must have the right to submit a first contract to binding arbitration at the request of the union.
    12. Labor must have the first right to buy out a company for sale or going bankrupt, or outsourcing to another state or country.
    13. Labor has the right to stock ownership and oversight of the investment of its own funds in the company where it works.

  6. When a company purchases or merges with another company, it must honor all existing collective bargaining agreements and contracts.

  7. Agricultural and other excluded workers must be covered by federal labor laws, except where state laws offer more protection.

  8. We support day-care service offered at every workplace or reasonably near the workplace..

  9. We encourage and support government subsidizing of cooperative ownership and management of enterprises whenever a buy-out is possible.

  10. Management’s right to close a workplace and move to a lower-pay locale must be circumscribed to protect the local workforce and their job security.

  11. We support the 35-hour work week.

  12. Occupational safety and enforcement (OSHA) is the law and must be enforced. This law protects workers against dangerous equipment, chemicals, polluted air, fertilizers and other workplace hazards indoors and outdoors. .

  13. The law on family medical leave for workers must not be circumvented, undermined or in any way reduced in range or time.
